Terms of Service
Last updated September 18, 2026
This is the agreement between BuybackOS and the businesses that subscribe to it. If you sold something to a business that uses BuybackOS, this page is not your agreement — theirs is on their own site, and they are who you deal with.
The agreement
These terms apply when you create an account, subscribe, or use the service. If you are agreeing on behalf of a company, you are confirming you are allowed to bind it. If you do not agree, do not use the service.
What you get
A subscription gives your organisation access to the BuybackOS application and its storefront for the plan you are on, for as long as you are paid up. Plans, limits, and prices are listed on the pricing page. We may change what the product does; we will not remove a feature you are paying for without notice.
Your account
You are responsible for what happens under your account, including what your staff do with it. Keep credentials to yourself, give people the least access they need, and tell us promptly if you think an account has been compromised.
Your data stays yours
Everything you and your customers put into the system — records, photos, documents, messages — remains yours. We are granted only the permission needed to host it, display it back to you, back it up, and keep the service working.
For the personal information of your customers, you decide what happens and we act on your instructions. That makes you responsible for having a lawful basis to collect it, for the notices you give your customers, and for answering their requests. We will help you answer them.
You can export your data at any time while your account is open. After it closes, it is available for 30 days and then deleted.
What you may not do
Do not use the service to break the law, and in particular do not use it to buy or resell goods you are not permitted to deal in. Do not use it to send messages people have not agreed to receive — the messaging features are for transactional contact with your own customers, and misusing them puts everyone's delivery at risk.
Do not resell or sublicense the service, try to extract its source, or use it to build a competing product. Do not probe or load-test the system without asking first; ask, and we will usually say yes and help.
Compliance is yours to meet
BuybackOS provides record-keeping, audit trails, identity-check prompts, recall checks, and signed agreements, because they make compliance easier to demonstrate. Having them does not mean you are compliant. The obligations that attach to buying and reselling regulated goods attach to you, and what the software records is only as good as what your people put into it.
Payment
Subscriptions are billed in advance through Stripe and renew automatically until cancelled. Fees are non-refundable except where the law requires otherwise. If a payment fails we will tell you and give you a chance to fix it before access is suspended. Cancelling stops the next renewal; it does not refund the current period.
Prices can change with 30 days' notice, taking effect at your next renewal.
Payments to your customers
Money you pay to the people you buy from moves between you and them. We record it, we do not hold it, and we are not a party to it. Getting the amount right, and paying it, is yours.
Availability
We aim to keep the service up and we monitor it, but we do not promise it will never be unavailable. Planned maintenance is announced in advance where we can.
Ending it
You can cancel at any time from your billing settings. We can suspend or close an account for non-payment, or for a breach of these terms serious enough to warrant it — with notice and a chance to put it right, unless the breach is one where notice would make things worse.
Warranties and liability
The service is provided as-is. To the fullest extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Neither side is liable to the other for indirect, incidental, special, or consequential damages, or for lost profits. Our total liability for any claim is limited to what you paid us in the twelve months before it arose. Nothing here limits liability that cannot lawfully be limited.
Indemnity
You will cover us against claims arising from your use of the service in breach of these terms or the law, including claims by your own customers about data you asked us to process.
Changes to these terms
Material changes are notified to account holders at least 30 days before they take effect. If you do not accept them, cancel before then and you will not be charged again.
Governing law
These terms are governed by the law of the state in which BuybackOS is organised, and both sides submit to the courts of that state.
